Former President Trump Asks High Court Approval for Military Reserve Forces in Illinois

On Friday, the White House submitted an urgent appeal to the US supreme court, requesting authorization to send state guard forces to Illinois.

This move is part of a larger campaign to increase the internal deployment of the armed forces in a number of cities run by Democrats.

Legal Battle Over Military Presence

In an urgent petition, the US Department of Justice pressed the bench to overturn a lower court ruling that had halted the sending of several hundred state guard troops to the Chicago region.

The federal judge had raised doubts about the administration's explanation for deploying forces, questioning its reasoning in light of regional circumstances.

A federal appeals court affirmed the initial ruling on midweek, leaving the stationing on standby while the court case proceeds.

Government's Justifications

The federal legal representative, speaking on behalf of the White House, wrote in the new filing that federal agents have often been “intimidated and assaulted” in the city of Chicago and the neighboring town of Broadview.

This site is home to an ICE holding center.

The former president has previously deployed national guard units to Chicago and Portland, following earlier sendings to Los Angeles, California, Memphis, and Washington DC.

The president has argued that armed forces involvement is necessary to control demonstrations and support immigration enforcement.

Political Resistance

Elected Democrats have strongly opposed the decision, claiming that the administration's assertions are overstated and partisan in nature.

They accuse the former president of exploiting his executive power to punish opponents.

Court officials have also expressed doubt about the White House's description of the situation.

Local leaders say that protests over immigration enforcement have been primarily small and peaceful, challenging the president’s description of “war zone” circumstances.

Jurisdictional Framework

At the core of the dispute is the administration's application of a national law allowing the president to take control of the military reserve only in situations of uprising or when “unable with the standard military to execute the regulations of the United States”.

The White House maintains that the personnel are required to defend US facilities and personnel from demonstrators.

Recent Actions

In recent weeks, the administration federalized three hundred members of the state guard of Illinois and directed additional guard from Texas troops into the Illinois.

As city officials criticized the decision, the former president escalated his rhetoric, urging the detention of Chicago’s mayor and the Illinois governor, both Democrats, alleging them of not managing to safeguard federal agents.

The state of Illinois and municipal government jointly sued the White House to stop the deployment.

On October 9, Judge April Perry, nominated by President Biden, delivered a immediate block blocking the command.

Regional Incidents

Meanwhile in the city, at least a dozen people were detained outside the federal detention center following intense clashes between Illinois state police and demonstrators.
